Court hears arguments on NYC's big soda ban

NEW YORK (AP) ? A state appeals court panel had few sweet words Tuesday for a city health regulation that would fight diabetes and obesity by setting a size limit on sugary beverages sold in restaurants.

The four justices peppered a city lawyer with tough questions during a Manhattan court session aimed at determining whether health officials exceeded their authority in placing a 16-ounce limit on most sweetened beverages at city-licensed eateries.

The regulation would apply to thousands of fast food joints, fine restaurants and sports stadiums, but not to supermarkets or most convenience stores. It was struck down in March by a lower-court judge, who found that the rules had too many loopholes that would undermine the health benefits while arbitrarily applying to some businesses but not others. The city appealed.

During oral arguments in the case Tuesday, the judges repeatedly challenged city attorney Fay Ng to defend the rule's scientific and legal underpinnings.

Justice David Friedman said the city appeared to be asking for unprecedented authority to regulate all sorts of portion sizes, including "the number of doughnuts a person could eat, the number of scoops of ice cream" and number of servings of fried chicken.

Several times, Justice Dianne Renwick questioned whether the 16-ounce size limit was scientifically arbitrary, given that it is based on liquid volume rather than a measure of how much sugar is actually in a beverage. The limit, she noted, meant that some drinks with high amounts of sugar would be allowed, while others with less sweetener would be banned.

After the court session, City Health Commissioner Thomas Farley said that he remained confident the regulation will ultimately be upheld.

New York City needs the rule to address a growing health crisis, he said. The Health Department released a report Monday saying that diabetes killed an all-time high of 5,695 city residents in 2011, or about one death every 90 minutes. Around 650,000 adult New Yorkers are now living with diabetes, an increase of 44 percent since 2002.

A lawyer for the American Beverage Association and a coalition of other groups that challenged the regulation acknowledged that too much sugar can be unhealthy, but he told the court the regulation was "a breathtaking example of agency overreach."

"For the first time, this agency is telling the public how much of a safe and lawful beverage it can drink," attorney Richard Bress said. "This is the government coercing lifestyle decisions."

He said the city's proposal seemed to be based more on politics and consumer economics than pure science. He noted that the rules, which contain an exception for dairy products, would prohibit restaurants from serving more than 16 ounces of cranberry or orange juice in a glass, while setting no limits on the size of a milkshake.

"That makes no sense at all as a matter of nutrition," he said.

The court didn't indicate when it might rule.

Looks like Pluto will have a moon named 'Vulcan'

The votes are in for the SETI Institute's Pluto Rocks Poll, and, thanks in part to William Shatner, Mr. Spock's home planet is a clear winner.?

During a Google+ Hangout today,?SETI Institute?senior scientist Mark Showalter ? who discovered the moons and opened up the poll ? talked with SETI astronomer Franck Marchis and MSNBC?s Alan Boyle about the voting results. Showalter admitted that he wasn?t quite sure how well the whole internet poll thing would work out, but he?s pleased with the results.

?I had no idea what to expect,? said Showalter. ?As we all know the internet can be an unruly place? but by and large this process has gone very smoothly. I feel the results are fair.?

As far as having a name from the Star Trek universe be used for an actual astronomical object?

?Vulcan works,? Showalter said. ?He?s got a family tie to the whole story. Pluto and Zeus were brothers, and Vulcan is a son of Pluto.?

And what can you say when even?Mr. Spock agrees?

The other winning name, Cerberus, is currently used for an asteroid. So because the IAU typically tries to avoid confusion with two objects sharing the same exact name, Showalter said he will use the Greek version of the spelling: Kerberos.

The next step will be to submit these names to the International Astronomical Union for official approval, a process that could take 1?2 months.

(Although who knows? maybe Bill can help move that process along as well?)

Warrant issued for Vegas Strip shooting suspect

LAS VEGAS (AP) ? Police said Monday they have a warrant for a 26-year-old ex-convict identified as the prime suspect in a shooting and fiery crash that killed three people last week on the Las Vegas Strip.

"We can say with certainty that Ammar Harris is the suspect who fired the fatal shots," Las Vegas police Capt. Chris Jones told reporters at an afternoon update about a manhunt that he said would be advertised on southern Nevada billboards.

Police previously released a photo of Harris taken after his arrest last year in Las Vegas in a 2010 prostitution case. It showed Harris with tattoos on his right cheek and words on his neck above an image that appeared to depict an owl with blackened eyes. Jones said Harris should be considered armed and dangerous.

Jones said investigators were looking everywhere Harris had lived in the past. He wasn't specific.

Public records show that Harris previously lived in South Carolina and Georgia, and told a police officer when he was arrested in Miami Beach last December that he had lived in Florida for about a year.

Harris was convicted in 2004 in Orangeburg, S.C., of felony possession with intent to sell a stolen pistol, Jones said. The conviction was not in California, as police said earlier.

Clark County District Attorney Steve Wolfson attended the news conference and said afterward that the case was getting top priority from prosecutors and he hoped Harris would turn himself in. He said the warrant was issued Friday.

"If Mr. Harris is listening, I would urge him to surrender," Wolfson said.

Harris used the name Ammar Asim Faruq Harris when he was arrested last May in Las Vegas in the June 2010 case. He was charged with robbery, sexual assault, kidnapping and coercion with a weapon.

Las Vegas police also sought pandering by force and ex-felon in possession of concealed weapon charges stemming from allegations that Harris was a pimp and attacked a woman.

Court records show the case was dismissed last June. The prosecutor and a public defender who handled the case didn't immediately respond to messages Monday.

In Miami Beach, Harris was arrested Dec. 7 after he was accused of driving a silver 2006 Hummer H3 the wrong way on a congested street at 2 a.m. The arresting officer said Harris produced a Florida state identification card and provided a Miami address. The status of the case in Miami-Dade courts was unclear Monday.

In Atlanta, Harris was arrested in June 2004 on a felony marijuana possession with intent to distribute charge. According to court records, he pleaded guilty to a misdemeanor marijuana possession charge and was sentenced to three months in jail.

Fulton County jail records show Harris spent about two weeks in jail in February 2008 after a misdemeanor battery arrest. The outcome of that case was not immediately clear Monday.

In Las Vegas, investigators say Harris was driving a black Range Rover SUV when he fired shots into a Maserati before dawn Thursday, killing an aspiring rapper and causing a crash that killed two people when the Maserati slammed into a taxi that exploded in a fireball at the heart of the Strip.

Police said several other people were with Harris in the SUV as it fled the scene of the six-vehicle, chain-reaction crash on Las Vegas Boulevard near the Bellagio, Caesars Palace, Bally's and Flamingo resorts.

Jones and police homicide Lt. Ray Steiber said they were confident that Harris was the only shooter. They didn't say whether police intend to prosecute anyone else in the SUV.

But, "To anyone who is aware of his location or is assisting Ammar Harris in any way, you will be arrested and prosecuted," Jones said. "You may think you're being a friend, but keep in mind Ammar Harris is wanted for the murder of three citizens."

The SUV was the focus of an intense search before it was found Saturday parked in the garage of a gated apartment complex just a couple of blocks east of the Strip. Harris wasn't found at a nearby apartment where he was believed to have been living.

Kenneth Wayne Cherry Jr. was mortally wounded when the dark gray Maserati he was driving was peppered by gunfire from the SUV. Taxi driver Michael Boldon, 62, of Las Vegas, and passenger Sandra Sutton-Wasmund, 48, of Maple Valley, Wash., died in the taxi.

Police say the triple homicide stemmed from an altercation between Cherry and Harris in a valet area of the upscale Aria resort a block south of the crash scene at Las Vegas Boulevard and Flamingo Road.

A passenger in the Maserati was wounded in the arm, and four people from four other vehicles were treated for non-life-threatening injuries after the crash.

Las Vegas police sought help during last week's search for the Range Rover from local and federal authorities in Nevada and neighboring states of Arizona, California and Utah.

S. Korea's new leader faces N. Korea nuke crisis

SEOUL, South Korea (AP) ? Even before she takes office Monday as South Korea's first female president, Park Geun-hye's campaign vow to soften Seoul's current hard-line approach to rival North Korea is being tested by Pyongyang's recent underground nuclear detonation.

Pyongyang, Washington, Beijing and Tokyo are all watching to see if Park, the daughter of a staunchly anti-communist dictator, pursues an ambitious engagement policy meant to ease five years of animosity on the divided peninsula or if she sticks with the tough stance of her fellow conservative predecessor, Lee Myung-bak.

Park's decision is important because it will likely set the tone of the larger diplomatic approach that Washington and others take in stalled efforts to persuade North Korea to give up its nuclear weapons ambitions.

It will also be complicated by North Korea's warning of unspecified "second and third measures of greater intensity," a threat that comes as Washington and others push for tightened U.N. sanctions as punishment for the Feb. 12 atomic test, the North's third since 2006.

That test is seen as another step toward North Korea's goal of building a bomb small enough to be mounted on a missile that can hit the United States. The explosion, which Pyongyang called a response to U.S. hostility, triggered global outrage.

Park has said she won't yet change her policy, which was built with the high probability of provocations from Pyongyang in mind. But some aren't sure if engagement can work, given North Korea's choice of "bombs over electricity," as American scientist Siegfried Hecker puts it.

"Normalization of relations, a peace treaty, access to energy and economic opportunities ? those things that come from choosing electricity over bombs and have the potential of lifting the North Korean people out of poverty and hardship ? will be made much more difficult, if not impossible, for at least the next five years," Hecker, a regular visitor to North Korea, said in a posting on the website of Stanford University's Center for International Security and Cooperation.

As she takes office, however, Park will be mindful that many South Koreans are frustrated at the state of inter-Korean relations after the Lee government's five-year rule, which saw two nuclear tests, three long-range rocket launches and attacks blamed on North Korea that killed 50 South Koreans in 2010.

Park's policy calls for strong defense but also for efforts to build trust through aid shipments, reconciliation talks and the resumption of some large-scale economic initiatives as progress occurs on the nuclear issue. Park has also held out the possibility of a summit with new North Korean leader Kim Jong Un.

Much is riding on Park's conclusion.

"The overall policy direction on North Korea among the U.S., Japan and South Korea will be hers to decide," said Victor Cha, a former senior Asia adviser to President George W. Bush. "If Park Geun-hye wants to contain, the U.S. will support that. But if Park Geun-hye, months down the road, wants to engage, then the U.S. will go along with that too. "

Engagement by Park would provide a sharp contrast with the rule of her father, Park Chung-hee, whose antipathy toward Pyongyang during his 18-year rule in the 1960s and '70s prompted a failed attack on the Blue House by 31 North Korean commandos in 1968. In 1974, Park's wife was shot and killed by a Japan-born Korean claiming he was acting on assassination orders by North Korea founder and then leader Kim Il Sung.

Critics say Park Geun-hye's North Korea policy lacks specifics. They also question how far she can go given her conservative base's strong anti-Pyongyang sentiments.

But Park has previously confounded ideological expectations. She travelled to Pyongyang in 2002 and held private talks with the late Kim Jong Il, the father of Kim Jong Un, and her gifts to Kim Jong Il are showcased in a museum of gifts to the North Korean leaders. During the often contentious presidential campaign, she responded to liberal criticism by reaching out to the families of victims of her father's dictatorship.

She said in her 2007 autobiography that she visited Pyongyang because she thought her painful experiences with the North made her "the one who could resolve South-North relations better than anyone else." She also wrote that Kim Jong Il apologized for the 1968 attack.

"I don't think this latest spike in the cycle of provocation and response undermines her whole platform of seeking to somehow re-engage the North," said John Delury, an analyst at Seoul's Yonsei University. North Korea wants a return of large-scale aid and investment from South Korea.

Before the election, Pyongyang's state media repeatedly questioned the sincerity of Park's engagement overture. Since the election, however, although regular criticism of Lee as "human scum" continues, the North's official Korean Central News Agency hasn't mentioned Park by name, though her political party is still condemned.

Pyongyang sees the nuclear crisis as a U.S.-North Korea issue, Delury said. "From a North Korean mindset, ramping up the tension and hostility with the U.S. does not equal jettisoning relations with the South."

Park may take a wait-and-see stance in coming months.

A possible positive turning point could come if North Korea resists tests or launches during April, when it celebrates two state anniversaries ? Kim Il Sung's birthday and the army's founding anniversary ? according to analyst Hong Hyun-ik at the private Sejong Institute in South Korea. Pyongyang conducted a failed long-range rocket launch during last year's celebrations.

Hong predicts that the United States will seek nuclear talks with North Korea in a few months, something that could help Park's efforts to engage North Korea.

"The nuclear test sets back and complicates but does not necessarily doom her engagement efforts over the long term," said Ralph Cossa, president of Pacific Forum CSIS, a Hawaii-based think tank.

Park warned after the test that North Korea faces international isolation, economic difficulties and, eventually, a collapse if it continues to build its atomic program. She also pressed Pyongyang to respond to her overtures.

"We can't achieve trust with only one side's efforts. Isn't there a saying that 'We need both hands to make a clapping sound?'" she said.

Oil levels off after 2 days of steep losses

(AP) ? The price of oil was little changed Friday after a 5 percent fall over the last two days. The drop in crude showed signs of slowing the upward spiral of gas pump prices as well, at least temporarily.

Benchmark crude for April delivery was down 12 cents to $92.72 a barrel on the New York Mercantile Exchange. Brent crude, used to price oil that many U.S. refineries use to make gasoline, rose 42 cents at $113.95 a barrel on the ICE Futures exchange in London.

At the pump the national average for a gallon of regular gas was $3.78, about where it was on Thursday, but 14 cents higher than a week ago and almost half a dollar more than a month ago, according to AAA. Drivers in California, Florida, the Northeast and the Midwest are paying the most.

Encouraging news about the global economy helped oil prices stabilize. The European Commission said Friday that it expects the recession afflicting the economy of the 17 countries sharing the euro to bottom out during the first half of the year, with growth reaching an annual rate of 0.7 percent in the fourth quarter. The EC expects growth in the eurozone to accelerate to 1.4 percent next year.

A stronger global economy is likely to mean more demand for oil and gas, which points to higher prices for fuel.

U.S. stock markets rebounded from a recent slump on concerns about the fate of the Fed's stimulus program and looming budget cuts in Washington. At midday the major indexes were all higher.

In other energy futures trading on the Nymex:

? Natural gas was up 1 cent at $3.25 per 1,000 cubic feet.

? Heating oil was unchanged at $3.10 per gallon.

? Wholesale gasoline rose 1 cent to $3.24 per gallon.

Voracious absences at the center of galaxies, black holes shape the growth and death of the stars around them through their powerful gravitational pull and explosive ejections of energy.

"Over its lifetime, a black hole can release more energy than all the stars in a galaxy combined," said Roger Blandford, director of the Kavli Institute for Particle Astrophysics and Cosmology and a member of the U.S. National Academy of Science. "Black holes have a major impact on the formation of galaxies and the environmental growth and evolution of those galaxies."

Gravitational forces grow so strong close to a black hole that even light cannot escape from within, hence the difficulty in observing them directly. Scientists infer facts about black holes by their influence on the astronomical objects around them: the orbit of stars and clumps of detectable energy.

With this information in hand, scientists create computer models to understand the data and to make predictions about the physics of distant regions of space. However, models are only as good as their assumptions.

"All tests of general relativity in the weak gravity field limit, like in our solar system, fall directly along the lines of what Einstein predicted," explained Jonathan McKinney, an assistant professor of physics at the University of Maryland at College Park. "But there is another regime?which has yet to be tested, and which is the hardest to test?that represents the strong gravitational field limit. And according to Einstein, gravity is strongest near black holes."

This makes black holes the ultimate experimental testing grounds for Einstein's theory of general relativity.

While black holes cannot be observed, they are typically accompanied by other objects with distinctive features that can be seen, including accretion disks, which are circling disks of superhot matter on our side of the black hole's "event horizon"; and relativistic jets, high-powered streams of ionized gases that shoot hundreds of thousands of light years across the sky.

In a paper published in Science in January 2013, McKinney, Tchekhovskoy and Blandford predicted the formation of accretion disks and relativistic jets that warp and bend more than previously thought, shaped both by the extreme gravity of the black hole and by powerful magnetic forces generated by its spin. Their highly detailed models of the black hole environment contribute new knowledge to the field.

For decades, a simplistic view of the accretion disks and polar jets reigned. It was widely believed that accretion disks sat like flat plates along the outer edges of black holes and that jets shot straight out perpendicularly. However, new 3D simulations performed on the powerful supercomputers of the National Science Foundation's Extreme Science and Engineering Discovery Environment (XSEDE) and NASA overturned this oversimplified view of jets and disks.

The simulations show that the jet is aligned with the black hole's spin near the black hole but that it gradually gets pushed by the disk material and becomes parallel to (but offset from) the disk's rotational axis at large distances. The interaction between the jet and disk leaves a warp in the accretion disk density.

"An important aspect that determines jet properties is the strength of the magnetic field threading the black hole," said Alexander Tchekhovskoy, a post-doctoral fellow at the Princeton Center for Theoretical Science. "While in previous works it was a free parameter, in our series of works the field is maximum: it is as strong as a black hole's gravity pull on the disk."

In the simulations, the twisting energy grows so strong that it actually powers the jet. In fact, the jet can reorient the accretion disk, rather than the other way around, as was thought previously.

"People had thought that the disk was the dominant aspect," McKinney said. "It was the dog and the jet was the wagging tail. But we found that the magnetic field builds up to become stronger than gravity, and then the jet becomes the dog and the disk becomes the wagging tail. Or, one can say the dog is chasing its own tail, because the disk and jet are quite balanced, with the disk following the jet ? it's the inverse situation to what people thought."

What does this have to do with Einstein and his theory of general relativity?

Astronomers are closer than ever to being able to see the details of the jets and accretion disks around black holes. In a September 2012 paper in Science, Sheperd Doeleman of MIT reported the first images of the jet-launching structure near the supermassive black hole, M87, at the center of a neighboring galaxy, captured using the Event Horizon Telescope, a very long baseline interferometry (VLBI) array composed of four telescopes at three geographical locations. It constituted a small sliver of a vast skyscape, yet the results give astronomers like McKinney, Tchekhovskoy and Blandford the hope that they will get their first comprehensive glimpse into the black hole's neighborhood in the next three to five years.

"We'll see the gases swirl around the black hole and other optical effects that will be signatures of a black holes in spacetime that one can look out for," said Blandford.

The observations will either match models like theirs, or they will be different. Both outcomes will tell researchers a lot.

"If you don't have an accurate model and anything can happen as far as you understand, then you're not going to be able to make any constraints and prove one way or another whether Einstein was right," McKinney explained. "But if you have an accurate model using Einstein's equations, and you observe a black hole that is very different from what you expected, then you can begin to say that he may be wrong."

The model Blandford and others generated using supercomputing simulations will help serve that comparative role. But they need to add one crucial element to make the simulations meaningful: a way of translating the physics of the black hole system into a visual signal as it would be seen from the vantage point of our telescopes, billions of light years away.

"We're in the process of making our simulations shine, so they can be compared with observations," McKinney said, "not only to test our ideas of how these disks and jets work, but ultimately to test general relativity."

Watch live: Sony unveils new PlayStation console

NEW YORK (AP) ? Sony unveiled its next-generation gaming system, the PlayStation 4, at a New York event Wednesday evening.

The development gives the struggling Japanese electronics company a head start over Microsoft and an Xbox 360 successor.

The PlayStation 4 will be Sony Corp.'s first major game console since the PlayStation 3 went on sale in 2006. Microsoft Corp. is expected to unveil the next Xbox in June at the E3 video game expo in Los Angeles. Last fall, Nintendo started selling the Wii U, though it plays catch-up in some respects in bringing the ability to play high-definition games.

Although the Xbox 360 came out a year before PlayStation 3, Microsoft's game machine has been more popular, largely because of its robust online service, Xbox Live, which allows people to play games with others online. The original Wii has sold more units since its launch than both its rivals, but it lost momentum as the novelty of its motion controller faded. Sales of the new Wii U have been slow.

Underscoring the importance of a new PlayStation and the U.S. market, Sony is holding its announcement event in New York rather than in Japan, as it had in the past. The event is at the Hammerstein Ballroom in midtown Manhattan.

Here's a running account of the PlayStation event, presented in reverse chronological order. All times are EST. Presenters include Andrew House, president and group chief executive of Sony Computer Entertainment Inc.; Mark Cerny, lead architect for the PlayStation 4; and David Perry, co-founder of the Internet game company Gaikai, which Sony bought last year.

Perry talks about Gaikai's vision of letting people explore any game in the PlayStation store for free. The idea is gamers will then buy what they like.

He says PlayStation 4 will allow for virtual spectating. With one button, you can broadcast your game play so friends can "look over your shoulder virtually."

It will have a feature called remote play, in which you run the game on the PlayStation, which then sends the video to your handheld PlayStation Vita device over the Internet so you can play remotely.

Cerny says the new PlayStation will have hardware compression so sharing video of game play will be easier. You can browse live game video of games your friends are playing.

Adopting Facebook's philosophy, Sony will transition to an online game network based on real names, even as people will also be able to keep their aliases.

Cerny appears in a plaid shirt and jeans as he touts the ease in which computer programmers will be able to write games for the new system. He says that with so many devices around, the value of having a powerful computer on a single chip has diminished. Instead, Sony is building the new PlayStation on top of a traditional PC architecture, and in doing so, game creators will have an easier time developing games.

Just before announcing the PlayStation 4, House refers to "a moment of truth and a bold step forward for PlayStation and the company." He says Sony is looking to offer powerful opportunities to connect and play, including on mobile through a companion PlayStation Vita released last year.

Triumph travelers file class action suit against Carnival

(Reuters) - The owner of the stricken Carnival Triumph cruise ship was hit by a lawsuit seeking class action status for stranding more than 3,000 passengers for five days on a ship without electricity or adequate sanitation.

Carnival Corp should be held liable for physical and emotional anguish inflicted on the passengers as well as punitive damages, according to the lawsuit by Matt and Melissa Crusan. The lawsuit was filed on Monday in U.S. federal court in Miami.

The Triumph was towed into Mobile, Alabama on Thursday, four days after a fire knocked out the ship's power while it was off the coast of Mexico.

The lawsuit alleged the world's largest cruise company failed to provide a seaworthy ship. In addition, "motivated solely by financial gain" Carnival negligently brought the Triumph to Mobile, where it would be repaired, rather than a closer Mexican port. That decision extended the trip by 350 miles, the plaintiffs said.

Passengers were exposed to disease as sewage and "human waste sloshed around the vessel as the vessel listed while drifting and/or while under tow," according to the lawsuit.

A Carnival spokesman, Vance Gulliksen, said the company does not comment on pending litigation.

The lawsuit seeks to represent all of the passengers on the stricken cruise.

The complaint said that the Triumph ticket limits passengers' rights to bring a class action, but that provision should be voided by Carnival's negligence in using an unseaworthy vessel and not towing the ship to the nearest port.

Carnival has offered Triumph passengers $500, reimbursement for their transportation and many onboard costs, and given them a credit toward a future cruise equal to the amount they paid for the Triumph vacation.

Jim Walker, who specializes in representing cruise ship passengers, told Reuters last week that the compensation offer was probably more than Triumph passengers would likely win in court. Walker is not involved in this suit and said he is unlikely to bring a case.

The class action lawsuit, which was filed by the Lipcon, Margulies, Alsina & Winkleman law firm in Miami, is at least the second by a Triumph passenger. On Friday, Cassie Terry of Brazoria County, Texas sued Carnival.

Michael Winkleman, an attorney with Lipcon, Margulies could not be reached for comment.

Like the Crusans, Terry sued for the conditions aboard the ship, which lacked working toilets and proper ventilation.

The case is Matt Crusan and Melissa Crusan v Carnival Corp, U.S. District Court, Southern District of Florida, No. 13-20592.

Why not make your own energy drink? | MNN - Mother Nature Network

Health concerns about the typical energy drink?are everywhere, so?you may not want to depend on them for energy. After all, not only can they be extremely high in caffeine, but they also tend to be full of sugar, artificial colorings and other unnatural ingredients. They don?t exactly fit my whole food, traditional diet criteria. The question is, how do you replace them?

But having an afternoon pick-me-up can be helpful, which is why I wanted to share a few recipes for simple homemade, energy drinks.

Chia Pomegranate Green Tea Cooler

Why it works: Tea is a natural source of caffeine, however it also contains an amino acid called ?theanine? which is a natural relaxer with anti-anxiety properties. It helps energize you without making you jittery. When you are stressed, both the energy boost from the caffeine and the relaxing effect of the theanine can be helpful. Pomegranate juice is full of nutrients, flavonoids, and antioxidants and is low in sugar. This healthy juice can help give you a boost from nutrition alone. (It?s also worth noting that according to Bowden, it is called the ?natural Viagra? and has been traditionally associated with love and sexual vitality.) The chia seeds were traditionally used as a support for long journeys. The gel-like substance they form when put in liquid absorbs slowly into the body, for a slow release of nutrients and energy. Chia seeds are high in vitamins and minerals, making them a favorite with many nutritionists.

Homemade Chocolate Milk

Directions: In a blender, mix 1 cup of whole milk with 1/2 to 1 tablespoon of fair trade cocoa powder, a dash of vanilla extract and 1 tablespoon of maple syrup or honey. Blend until combined.

Why it works: Milk gives you good source of both protein and fat for sustained energy. Milk also contains some natural sugar that gives a boost of energy. Use grade B maple syrup for a higher nutrient content, and you will add both more natural sugars for a more instant energy boost. The cocoa powder gives some caffeine, as well as more antioxidants and nutrients (such as magnesium). I prefer raw, pastured milk.

Green Drink

Directions: The darling of the raw foodie and many health conscience people, the green drink trend shows no sign of slowing down and there are many green drink mixtures available online. Make according to the package directions, or add a scoop to a smoothie.

Why it works: Green drinks work because they are high in nutrients, very alkalizing (which makes you feel refreshed and energized). Plus, some mixes contain herbs known for their energizing attributes. Mix them with a pomegranate, noni, or other antioxidant-rich juice, or combine with a high protein snack like nuts or canned fish for sustained energy.

The above recipes are gentle, natural options for an energy boost and are perfect for a mid-day drink. Being more natural, and not as high in caffeine, they may not keep you in a working frenzy all night long when you need it, but on the plus side, they offer many health benefits.?

Sony reveals PlayStation 4, fires first shot in console war

After months of rumor and speculation, Sony has revealed its new game machine ? the PlayStation 4 ? as well as a new controller with a touchpad, a "share" button and light bar.

"Today marks a moment of truth and a bold step forward for PlayStation as a company," said Andrew House, president and Group CEO of Sony Computer Entertainment, as he took the stage at the Hammerstein Ballroom in New York City on Wednesday. "Today we will give you a glimpse into the future of play."

House told a room packed full of journalists that the new machine ? the successor to the PlayStation 3 ? would take the moniker PlayStation 4. Sony then revealed the new touch-sensing DualShock controller as well as a new "stereo camera" that works in conjunction with the controller (see video below.)

Sony said the PlayStation 4 will launch "holiday 2013" but did not reveal a specific date or a price. Sony also did not show off what its new gaming hardware will look like, revealing only the controller and pictures of the new camera.

Mark Cerny, the PS4's lead system architect, did outline some of the innards that will be powering the machine explaining, ?The architecture we chose is like a PC in many ways.?

The PlayStation 4 will feature an X86-64 AMD Jaguar CPU with 8 cores, an AMD Radeon GPU and 8 gigabytes of unified system memory. Like the PS3, it will also feature a Blu-ray drive. (For more on the specs, check out our story here.)

David Perry ? CEO and founder of Gaikai ? also took the stage Wednesday. Sony bought his game streaming company last year. He explained that integration of the streaming service with the PlayStation Store will allow gamers to instantly try games before they buy them.

Meanwhile, Perry said that with the "share" button on the new PS4 controller players will be able to live broadcast their gameplay to their PlayStation Network friends.

He said friends will not only be able to watch your game in action, but can post comments to your screen as you play (if you let them). You'll also be able to allow friends to take over your game so they can, say, assist you in a difficult area or interact with your game in other helpful ways.

"What we?re creating is the fastest, most powerful network for gaming in the world," Perry said. "Our vision is to create the first social gaming network with meaning."

Perry also revealed Remote Play ? a feature that will allow gamers to take their PS4 action to Sony's smaller game screen. That is, if you're in the middle of playing a game on your PS4, you can use Remote Play to instantly transfer your game to Sony's handheld PS Vita.

Perry said the ultimate goal is to make it so all PS4 games will be playable on the Vita.

PlayStation 4 games unveiled
So what games will be coming to the PlayStation 4? Bungie ? the creator of the Xbox-exclusive Halo game franchise ? revealed it will be bringing its newly revealed project "Destiny" to the PlayStation 4 (with an edition also for the PlayStation 3).

Hermen Hulst, co-founder of Guerrilla Games, introduced "Killzone: Shadow Fall" a stunning looking futuristic shooter. And Matt Southern from Evolution Studios showed off the ultra-realistic "Driveclub" racing game.

"We?ve gone borderline insane with the real-world details," Southern said, pointing out the ultra-fine detail that can be seen on the cars in the game.

Meanwhile, Sucker Punch's Nate Fox revealed the new game from the studio that brought us the "InFamous" series. He said "InFamous: Second Son" ? a game about what happens when super powers and the power of surveillance collide ? will be a PlayStation 4 exclusive.

Respected indie developer Jonathan Blow ? the creator of the critically acclaimed game "Braid" ? showed off his next game "The Witness." He said the puzzle-filled title will be a PlayStation 4 "launch window" game.

Ubisoft's Yves Guillemot revealed what everyone expected ? that the developer's highly anticipated game of surveillance and hacking called "Watch Dogs" is planned for the next-gen PlayStation 4.

In something of a surprise, PC gaming stalwart Blizzard revealed that it'll be bringing "Diablo 3" to both the PlayStation 4 and the PlayStation 3.

And it appears that Sony won?t be saying goodbye to its oft-ignored PlayStation Move motion controller. Media Molecule ? the developers behind the ?LittleBigPlanet? games ? showed off a tool that enables players to use the Move controller and the PS4 to craft digital sculptures and bring them to life.

The battle ahead
Sony, Microsoft and Nintendo have been duking it out for years, vying to be the prime purveyor of home video games and, in recent years, other home entertainment as well. But Sony's news today is the opening shot in an all new console war.

It's been six years since Sony launched the PlayStation 3 and seven years since Microsoft launched its competing Xbox 360. Late last year, Nintendo revealed the Wii U ? its new home game machine and the successor to the Wii. But so far, the Wii U's lackluster sales and technical specs that make it seem more on par with the current generation Xbox 360 and PlayStation 3, suggest this machine is more of an interim step in the three-way gaming battle.

With Microsoft rumored to be working on its own new home game console (which it will reportedly unveil in the coming weeks), it is Sony and Microsoft that are widely expected to go head-to-head in the coming years, vying for the same demographic and to become the all-important entertainment hub in your household.

SYRACUSE -- Larry Flynt, the controversial publisher of HUSTLER Magazine, will speak at Syracuse University next month.

He is a staunch advocate of the First Amendment, and will speak on "Fighting for the First Amendment" at 5 p.m. March 5 at the Goldstein Auditorium in the Schine Student Center. Flynt will be a guest of the Newhouse School's Tully Center for Free Speech. The event is part of the?Tully Center's Distinguished Speakers Series.

CNYCentral Anchor Megan Coleman will sit down with Larry Flynt for a one-on-one interview next month.

Flynt is an outspoken defender of First Amendment rights. Throughout his career, he has been involved in numerous legal battles regarding the regulation of free speech in the U.S., including the Supreme Court case HUSTLER Magazine vs. Falwell back in 1988. The historic decision found the interest in protecting free speech surpasses the interest in protecting public figures' emotions and reputations. "This year marks the 25th anniversary of that famous case, which is one of the most important free speech cases in our history," says Roy Gutterman, director of the Tully Center. "It will be an honor to be able to talk about this case and others with the man who has fought so hard for these First Amendment principles."

Flynt still serves as the chairman of the HUSTLER brand of properties.

The event is free and open to the public. Tickets are required and will be available from the Schine Box Office starting on February 20 for students and February 26 for the general public. Parking will be available in University Avenue Garage or Booth Garage for $5.

North Korea video: Welcome to theater of the bizzare

North Korea posted a strange video about an attack on New York City, accompanied by the tune 'We are the World.' Why you shouldn't worry.

A propaganda video released by North Korea showing New York City being bombed is pure fantasy ? and just another weird window on the Hermit Kingdom's propaganda machine.

First, North Korea doesn't have a space shuttle (or the capability to launch one), as the video portrays in a boy's dream.

Second, North Korean doesn't yet have the capability to reach the US with one of their Unha rockets, let alone New York City.

As The Christian Science Monitor reported recently: "Concerns about their missile tests are overblown, according to RAND analyst Markus Schiller in a lengthy 2012 report on North Korea?s missile programs.

?Every launch further depletes the limited North Korean arsenals, and North Korea gains no real experience from these events. Since the purpose of the launches seems to be political, the United States and other nations should downplay or even ignore them,? he writes.

But this is classic North Korean propaganda, a sort of geopolitical WWE. All bluff and bluster. This latest video, like many before it, ignores copyrights and rips off from others.

Exhibit A of both weird and stolen: The theme music to this attack is "We are the World" by Lionel Richie and Michael Jackson. Really.

Exhibit B: The scenes of the New York attack are literally pulled directly from the video game "Call of Duty: Modern Warfare 3." according to the blogger Kotaku. Apparently, Activision agrees. They complained and YouTube took down the North Korean video.

Remember, this video is a North Korean boy's dream sequence, and it may be an apt metaphor for North Korea's ambition to be taken seriously around the world. That isn't to say that the leadership's nuclear ambitions aren't real and don't present a threat, especially to its neighbors.

"North Korea is likely to carry out multiple nuclear tests at two places or more simultaneously" to maximize scientific gains from the event, said South Korea?s outgoing President Lee Myung-bak in an interview with the Choson Ilbo newspaper today, according to Agence France-Presse. And the UN voted last month to increase the sanctions on North Korea.

But don't confuse North Korea's silly propaganda with reality.

If you peruse the North Korea YouTube channel, you will find Disney characters and an homage to North Korea's fantasy world. You will find North Korean soldiers in a kazoo orchestra, a brand new (and completely empty) bowling alley, and 40 minutes of synchronized swimming, according to Business Insider.

You can't make this stuff up. Oh, wait, yes you can if you're in North Korea.

Law would protect thousands of firearms

WASHINGTON (AP) ? Congress' latest crack at a new assault weapons ban would protect more than 2,200 specific firearms, including a semi-automatic rifle that is nearly identical to one of the guns used in the bloodiest shootout in FBI history.

One model of that firearm, the Ruger .223 caliber Mini-14, is on the proposed list to be banned, while a different model of the same gun is on a list of exempted firearms in legislation the Senate is considering. The gun that would be protected from the ban has fixed physical features and can't be folded to be more compact. Yet the two firearms are equally deadly.

"What a joke," said former FBI agent John Hanlon, who survived the 1986 shootout in Miami. He was shot in the head, hand, groin and hip with a Ruger Mini-14 that had a folding stock. Two FBI agents died and five others were wounded.

Hanlon recalled lying on the street as brass bullet casings showered on him. He thought the shooter had an automatic weapon.

Both models of the Ruger Mini-14 specified in the proposed bill can take detachable magazines that hold dozens of rounds of ammunition. "I can't imagine what the difference is," Hanlon said.

President Barack Obama has called for restoring a ban on military-style assault weapons and limiting the size of ammunition magazines.

A bill introduced last month by Sen. Dianne Feinstein, D-Calif. would ban 157 specific firearms designed for military and law enforcement use and exempt others made for hunting purposes. It also would ban ammunition magazines that hold more than 10 rounds.

Yet there are firearms that would be protected under Feinstein's proposal that can take large capacity magazines like the ones used in mass shootings that enable a gunman to fire dozens of rounds of ammunition without reloading.

Feinstein said in a written response to questions from The Associated Press that the list of more than 2,200 exempted firearms was designed to "make crystal clear" that the bill would not affect hunting and sporting weapons.

The December shooting at an elementary school in Newtown, Conn., that left 26 students and educators dead forced Washington to focus on curbing gun violence, a risky political move not tried in decades.

The gun industry, which is fighting any sort of ban, says gun ownership in the U.S. is the highest it's ever been, with more than 100 million firearms owners.

Obama and Vice President Joseph Biden have traveled around the country in an effort to gain support for new laws. Feinstein's proposal is the only sweeping piece of legislation designed to ban assault weapons currently being considered.

But some gun experts say the lists of banned and exempted firearms show a lack of understanding and expertise of guns.

"There's no logic to it," said Greg Danas, president of a Massachusetts-based expert witness business and firearms ballistic laboratory. "What kind of effect is it going to have?"

Feinstein's bill defines an assault weapon as a semi-automatic firearm with a detachable magazine that has one of several military characteristics that are specified in her legislation. Examples of those characteristics include a pistol grip, which makes a firearm easier to hold, and a forward grip, which makes the firearm easier to stabilize to improve accuracy. The definition is similar to the one in Congress' original ban on assault weapons, which went into effect in 1994 and was widely criticized for outlawing firearms based on cosmetic features.

Feinstein was behind the 1994 law which, at the time, protected more than 600 firearms. The current bill would exempt by name and model more than 2,200 firearms by name and model.

Feinstein said her staff had worked for more than a year to draft updates for the ban that expired in 2004, and it was apparent in the wake of recent mass shootings that now was the time to introduce a new bill. She said her staff consulted with law enforcement agencies and policy experts for months to create the expanded list.

Naming firearms that would remain legal under an assault weapons ban is a politically motivated gesture that was used to help pass the original ban in the early 1990s, people familiar with the process said.

Any firearm that does not fall within the law's definition of an assault weapon would not be banned. As a result, the list gives vulnerable politicians cover from constituents who do not want to give up their firearms.

For example, a politician can look at the list and assure a constituent that the government would not ban the firearm he or she loves to use for deer hunting. Under the 1994 law and the currently proposed one, the government would not have the authority to take away guns people already legally own. The ban would only apply to specific firearms manufactured and sold after the law is enacted.

A list of exempted firearms was not part of Feinstein's original assault weapons ban two decades ago, said Michael Lenett, one of the lead congressional staffers on gun control issues in 1994. A separate bill in circulation exempted far fewer hunting and sporting firearms, Lenett said.

The purpose of creating such a list was to assure people that the government was not going after any legitimate hunting or sporting weapons. "The other purpose of the list was to have a high profile way of assuring certain folks ? including legislators ? that we would not be going after their weapons that they use for those legitimate purposes," Lenett said.

"It was a win-win situation," Lenett recalled, because, he said, if the list could help pick up votes needed to pass the bill and temper some of the opposition, it could assuage some opponents of the ban without making the law less effective.

But gun experts say the lists in 1994 and the expanded lists of today don't make much sense.

"The bill demonstrates a shocking ignorance of the product they are purporting to regulate," said Lawrence Keane, senior vice president of the National Shooting Sports Foundation, a trade association based in Newtown, Conn., that represents gun manufacturers. "I have no idea how they arrived at this list. It would seem to be random, bordering on throwing darts at a dart board."

For instance, Feinstein's current proposal includes exemptions for three specific types of the M-1 Carbine, an assault rifle designed for the military that the U.S. currently bans from being imported. A draft of the legislation, created and modified in November and early December last year, banned the M-1 Carbine and didn't exempt any models, according to a copy obtained by the AP.

Feinstein said there was disagreement among firearms experts, law enforcement and gun safety organizations about whether to include the M-1 Carbine on the list of banned weapons.

"It has been used in multiple police shootings, and was originally used by U.S. soldiers on the battlefield," Feinstein said. "On the other hand, it comes in models that would not meet the military characteristics test." She said she decided to limit banned weapons to those that met the definition outlined in the bill.

At a Jan. 30 hearing by the Senate Judiciary Committee on gun violence, National Rifle Association President Wayne LaPierre said Feinstein's bill is "based on falsehoods to people that do not understand firearms, to convince them that the performance characteristics of guns that they are trying to ban through that bill are different than the performance characteristics that they're not trying to ban."

The Ruger Mini-14 is a perfect example.

The model that has a fixed stock would be exempted by Feinstein's ban; the weapon was protected in the 1994 law as well. A Ruger Mini-14 with a collapsible and folding stock would be illegal.

The guns fire the same caliber bullet and can take detachable magazines that could hold dozens of rounds of ammunition. The folding stock only reduces the gun's length by 2.75 inches, according to the manufacturer's website.

"It's irrelevant," Edmund Mireles, an FBI agent who survived the Miami shootout, said of the differences in features. "They're equally dangerous."

Mark D. Jones, a senior law enforcement adviser for the University of Chicago Crime Lab, said the folding stock does not affect the firearm's lethal potential.

"Given that both firearms will accept a 30 round or larger magazine, it renders the differences between them entirely cosmetic," Jones said.

Kristen Rand, the legislative director at the Washington-based Violence Policy Center, said the Ruger Mini-14 model that would be banned under Feinstein's legislation is easier to hold while firing because it has a pistol grip, and it's easier to hide because it has a collapsible stock. That's what makes it more dangerous that the Ruger Mini-14 with the fixed stock which would be exempted under the Feinstein bill, she said.

"And that's supposed to save somebody's life?" asked Hanlon, the FBI agent shot alongside Mireles.

Hanlon considered the differences between the two models and whether the events of April 11, 1986, would have been different if the shooter used a Ruger Mini-14 with a fixed stock. "I don't think it would have changed a damn thing," he said. "I don't see what makes that gun less dangerous."
